The Battery Waste Management (BWM) Rules, 2022, notified by the Ministry of Environment, Forest & Climate Change (MoEFCC), replaced the earlier Batteries (Management & Handling) Rules, 2001. The framework has been further strengthened through amendments in 2023, 2024, and 2025, increasing compliance requirements, EPR targets, and environmental accountability.

📌Note: The 2023 Amendment added explicit sub-categories for three-wheeler EVs (L5, L5-M, L5-N) and E-carts. Batteries used in arms, ammunition, military equipment, and space-launch equipment are exempted from BWM Rules.

📌How to meet targets: Producers fulfil targets by procuring EPR Certificates from CPCB-registered recyclers / refurbishers. Certificates are traded on the CPCB portal; prices are regulated by CPCB (revised every 6 months) within floor & ceiling bands.

Environmental Compensation (EC) for Non-Compliance

CPCB’s Guidelines of September 2024 split EC into two regimes. Regime 1 penalises shortfalls in metal-wise EPR targets; Regime 2 covers all other BWM defaults. The penalty also increases 10% every year if repeated.

⚠️Critical: Paying EC does not waive the original EPR obligation — the unfulfilled target carries forward to the next year. Non-payment can lead to prosecution under Section 15 of the Environment (Protection) Act, 1986 — imprisonment up to 5 years and/or fine up to ₹1 lakh, with daily penalty ₹5,000 for continuing offences.

Who needs EPR registration under BWM Rules 2022?

All Producers, importers, manufacturers, recyclers, and refurbishers of any battery must register on the CPCB EPR portal. A Producer is defined broadly to include anyone who manufactures and sells, sells under its own brand, or imports batteries (including refurbished batteries and equipment containing batteries). There is no turnover or volume threshold — every entity must register.

How long does CPCB battery EPR registration take?

CPCB grants Producer registration within 15 working days of receiving a complete application with all documents and fees. If CPCB raises queries, the applicant has 15 days to respond — each round of queries adds time. Practical timelines with query handling are typically 4–6 weeks. Recycler / refurbisher registration also requires SPCB NOC, which can extend timelines.

What are the EPR collection targets for batteries?

Targets are set in Schedule II. For EV batteries, collection starts at 70% in FY 2024-25, rising to 80% in 2025-26 and 90% from 2026-27. Material recovery reaches 90% for EV & portable batteries by 2026-27 and 60% for automotive & industrial batteries. From FY 2027-28, producers must also include 5% recycled material in new batteries, rising to 20% by FY 2030-31.

What is the validity of CPCB battery EPR registration?

Following the Battery Waste Management (Amendment) Rules 2023, the Producer registration certificate issued by CPCB is valid until cancelled or withdrawn — there is no fixed expiry. However, registration must be updated for any change in particulars (address, product list, ownership), and annual returns must be filed to keep it active.

What is Environmental Compensation (EC)?

EC is a financial penalty for non-compliance under the polluter pays principle. As per CPCB’s September 2024 Guidelines:
• Regime 1 applies to Producers who miss metal-wise EPR targets.
• Regime 2 applies to all entities for other defaults: ₹20,000 (1st default), ₹40,000 (2nd), ₹80,000 (3rd), increasing 10% annually.

Paying EC does not remove the original compliance obligation.

Can imported waste batteries be recycled for EPR credits?

No. The 2023 Amendment explicitly prohibits generation of EPR Certificates for recycling or refurbishment of imported waste batteries. Only waste batteries generated within India qualify for EPR credits.

How do EPR certificates work?

Registered recyclers and refurbishers generate EPR Certificates (measured in kg of battery waste processed) on the CPCB portal after verification of recycling evidence. Producers purchase these certificates to fulfil their collection and recycling targets. CPCB regulates floor and ceiling prices every 6 months. Certificates are category-specific and must match the battery categories sold by the Producer

What if my product contains a battery but I don't sell batteries separately?

You are still classified as a Producer under BWM Rules. Anyone importing or selling equipment containing a battery — such as laptops, e-bikes, UPS systems, power tools, medical devices, smart watches, or other electronic equipment — must register and meet EPR obligations based on battery weight.

What is the CPCB EPR Portal and how do I access it?
